A DUI arrest triggers two separate legal proceedings. Winning in criminal court does not automatically restore your license at the DMV.


The Administrative (DMV) Case: The 10-Day Rule You have exactly 10 calendar days from your arrest to challenge the automatic suspension of your license. The citation you received acts as a temporary 10-day permit.

  • Option A: Formal Review Hearing. We challenge the legality of the stop. If we win, the suspension is deleted from your record.
  • Option B: The Eligibility Waiver. For first-time offenders, you can waive the hearing to receive an immediate “Business Purposes Only” license, avoiding any “hard” downtime where you cannot drive.

The Criminal Court Case Held at the Richard E. Gerstein Justice Building, the State must prove your normal faculties were impaired or your Blood Alcohol Level (BAL) was .08 or higher.

Penalty Tiers: What's Really At Stake

Florida law mandates specific “floor” penalties that judges cannot waive upon conviction.


First DUI Conviction

  • Fines: $500 to $1,000 (minimum $1,000 if BAL is .15+ or a minor was present).
  • Jail: Up to 6 months (9 months if BAL is .15+).
  • License Revocation: Mandatory 180 days to 1 year.
  • Ignition Interlock (IID): Mandatory for 6 months if BAL is .15+ or a minor was present.

Second DUI Conviction

  • Within 5 Years: Mandatory 10 days in jail, 30-day vehicle impoundment, and a 5-year license revocation.
  • Fines: $1,000 to $2,000.
  • IID: Mandatory for at least 1 year.

Third & Subsequent DUIs

  • Within 10 Years: This is a Third-Degree Felony carrying up to 5 years in prison and a 10-year license revocation.
  • Fourth DUI: Permanent lifetime revocation with no hardship eligibility.

The “Back On Track” (BOT) Diversion Program

Miami-Dade offers a lifeline for eligible first-time offenders to avoid a permanent DUI conviction.

  • Tier 1 (BAL < .15): 6 months of supervision, 40 hours of community service, and a 3-month Ignition Interlock requirement.
  • Tier 2 (BAL .15+ or Refusal): 9 months of supervision, 60 hours of community service, and a 6-month Ignition Interlock requirement.
  • The Result: If completed, the charge is reduced to Reckless Driving with Adjudication Withheld, allowing you to eventually seal your record.

Under “Implied Consent,” a first refusal leads to a 1-year license suspension. A second refusal is a misdemeanor. While it deprives the State of BAC evidence, the “refusal” itself can be used against you in court.

This new law includes “No Valid License” convictions as predicates for Habitual Traffic Offender (HTO) status. If you are caught driving while your license is revoked for a DUI, you face accelerated HTO designation and a 5-year mandatory revocation.

Under 2026 regulations, if your BAL was .16 or higher, any replacement ID issued will feature a prominent red stripe and the text “No Alcohol Sale.”

If the second offense was within 5 years, you must wait one full year before you can even apply for a hardship hearing.

In a crash, statements made to an officer for the purpose of the crash report are generally inadmissible in your criminal trial. We use this to suppress admissions of “how many drinks” you had.
